Industri halal merupakan industri yang paling berkembang pesat di seluruh dunia termasuk negara muslim dan bukan muslim. Pengguna telah memilih produk halal sebagai produk utama mereka untuk diguna pakai dalam kehidupan harian kerana ia membawa manfaat yang besar untuk kehidupan mereka. Walaupun industri halal berkembang dengan pesat, akan tetapi terdapat pelbagai isu halal yang dilakukan oleh pemain industri halal sehingga memberi kesan kepada pasaran halal. Bagi menangani isu halal yang berlaku di pasaran, terdapat undang-undang yang berkaitan dengan halal di Malaysia bertindak sebagai mekanisme untuk melindungi pengguna dan memastikan semua aktiviti halal dijalankan mengikut piawaian. Objektif kajian ini adalah bertujuan untuk mengkaji undang-undang yang berkaitan dengan halal dalam menyelesaikan isu hala seperti persembahan halal, logo halal dan isu kebersian premis. Dengan menggunakan kaedah penyelidikan dengan mengkaji akta, kajian ini adalah khusus daam menganalisis peruntukan undang-undang yang berkaitan dengan halal. Pengkaji juga membincangkan isu-isu halal yang tertakluk dibawah tiga akta berkaitan iaitu Akta Perihal Dagangan 2011, Akta Makanan 1983 dan Peraturan Kebersihan Makanan 2009. Daripada akta yang berkaitan, penyelidik menganalisa isu halal yang dilaporkan di dalam berita bagi mengenalpasti kesalahan yang dilakukan oleh pemain industri semasa dalam pasaran halal. Kajian ini berharap dapat memberikan informasi dan kefahaman yang penting atas pelaksanaan undang-undang dalam menyelesaikan isu halal bagi memastikan isu tersebut dapat dibasmi secara berkesan.
The halal industry is the fastest growing industry in the world including muslim and non-muslim countries. Consumers have chosen halal products as their main products to use in their daily lives because they bring great benefits to their lives. Although the halal industry is growing rapidly, there are things that arise in the halal market because it can have a negative impact on the halal industry. In order to eradicate halal issues that occur in the market, Malaysia has developed related halal laws as a mechanism to protect consumers and ensure that all halal activities are carried out in accordance with acts, laws, regulations, and standards. The objective of this study is to examine the implementation of halal law in combating halal issues such halal presentation, halal logos and premises cleanliness. Through the method of legal study, this paper analyzes the relevant legal provisions governing all matters related to halal. The researcher studies the halal issues that are subject to three related acts namely Trade, Food Act 1983, Food Hygiene Regulations 2009. By analyzing issues based on reported news cases, implementation and offenses under halal can be identified to enable industry players well aware on the things that are allowed and prohibited action while building the halal brand in the market. This study is expected to be able to provide an understanding of the law that is the solution to solve the halal issues that still exist in the halal market, including the issue of halal presentation, halal logos and cleanliness of the premises.
